Overview

Seaya is the world’s first cruise-based social media platform, developed and operated by Seaya International LLC, a Florida-based company. Seaya connects cruise passengers through shared voyages, port experiences, and travel communities. The Seaya application is available on both the Apple App Store and Google Play.

Seaya International LLC is committed to maintaining a safe, respectful, and lawful environment for all users. This document constitutes Seaya’s publicly accessible Child Safety Standards, addressing the prohibition and prevention of Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). These standards apply to all users of the Seaya application across both platforms and all jurisdictions in which Seaya operates.
This policy applies specifically to the Seaya application (Google Play package ID: com.seaya.app and iOS package ID: io.seaya.seaya), available on Google Play and the Apple App Store.
This policy is designed to meet or exceed the child safety requirements of the Apple App Store (App Review Guidelines, including Guidelines 1.2 and 1.3) and the Google Play Child Safety Standards policy applicable to Social and Dating category applications.

Definitions

CSAE (Child Sexual Abuse and Exploitation) refers to any content or behavior that sexually exploits, abuses, or endangers a person under the age of 18. This includes grooming a child for sexual exploitation, sextortion, trafficking of a child for sexual purposes, or any other form of sexual exploitation of a minor.

CSAM (Child Sexual Abuse Material) means any visual depiction, including photographs, videos, illustrations, or computer-generated imagery, involving the use of a minor in sexually explicit conduct. CSAM is illegal under United States federal law and the laws of most jurisdictions worldwide.

Minor means any person under the age of 18, or the age of majority in their applicable jurisdiction, whichever is higher.

Prohibited Content and Conduct

Seaya expressly prohibits all users of the Seaya platform from engaging in, facilitating, distributing, or promoting any form of Child Sexual Abuse and Exploitation. The following conduct and content are strictly forbidden and will result in immediate account termination, content removal, and reporting to relevant authorities:

  • Creating, uploading, sharing, or distributing CSAM or any sexually explicit content depicting or targeting minors.
  • Grooming of minors, including forming inappropriate online relationships with children for the purpose of facilitating sexual contact or the exchange of sexual material.
  • Sextortion, including threatening or blackmailing any minor using real or alleged intimate imagery.
  • Soliciting, recruiting, advertising, or trafficking minors for commercial sexual exploitation.
  • Sexualization of minors, including any content that depicts, promotes, or normalizes the sexual abuse of children.
  • Inappropriate interaction targeted at a child, including sexual messages, unsolicited advances, or contact of a sexual nature directed at a minor.
  • Sharing personal information of a minor without appropriate consent for the purpose of exploitation or harm.
  • Any other conduct that sexually exploits, abuses, or endangers a child, as defined under applicable law.

In-App User Reporting Mechanism

Seaya provides accessible mechanisms within the application that allow any user to report content or behavior they believe violates these child safety standards or Seaya’s Community Guidelines. Reports can be submitted directly within the Seaya application without requiring the user to leave the app. Seaya’s moderation team reviews all reports and takes timely action in accordance with these published standards.

In-app reporting capabilities include:

  • Reporting individual posts, profiles, messages, or other content as abusive or inappropriate.
  • Flagging content as potentially involving the exploitation or endangerment of a minor.
  • Blocking and muting other users directly within the application.
  • Submitting concerns to the Seaya support and moderation team via in-app contact channels.

Users may also contact Seaya’s dedicated child safety team directly at abuse@seaya.io.

In accordance with Apple App Store Guideline 1.2, Seaya commits to reviewing and responding to reports of objectionable content, including potential CSAE or CSAM, within 24 hours of receipt. Confirmed violations result in immediate removal of the content and action against the responsible account.

Content Moderation and Filtering

Seaya maintains content moderation processes to detect, review, and remove objectionable material from the platform, including content that may constitute CSAE or CSAM. Moderation measures include:

  • Proactive review of reported content by the Seaya moderation team.
  • Automated and manual filtering mechanisms to detect objectionable material before or after it is posted to the platform.
  • The ability to remove content and suspend or permanently terminate user accounts that violate these standards.
  • Blocking mechanisms that prevent ejected users from re-accessing the platform under the same account.

Seaya’s moderation approach is consistent with the requirements of Apple App Store Guideline 1.2 (User Generated Content) and Google Play’s Child Safety Standards policy for Social category applications.

Response to CSAM

Seaya takes immediate and decisive action upon obtaining actual knowledge of the presence of CSAM on the Seaya platform. Our response protocol includes:

  • Immediate removal of the identified CSAM content from the Seaya platform.
  • Suspension or permanent termination of the user account responsible for the content.
  • Mandatory reporting of confirmed CSAM to the National Center for Missing and Exploited Children (NCMEC) via the CyberTipline at report.cybertip.org, as required by 18 U.S.C. Section 2258A.
  • Cooperation with law enforcement agencies and relevant authorities in any resulting investigation.
  • Preservation of relevant records, metadata, and account information in accordance with applicable law and as requested by law enforcement.
  • Reporting to relevant regional authorities where applicable for users outside the United States, including the Internet Watch Foundation (IWF) in the United Kingdom and other applicable regional bodies.

Compliance with Child Safety Laws

Seaya complies with all applicable child safety laws and regulations in the jurisdictions in which it operates, including but not limited to:

  • The PROTECT Our Children Act (18 U.S.C. Section 2258A), which mandates reporting of apparent CSAM to NCMEC.
  • The Children’s Online Privacy Protection Act (COPPA), which governs the online collection of personal information from children under the age of 13.
  • The UK Online Safety Act 2023, as Seaya expands its operations into the United Kingdom.
  • The General Data Protection Regulation (GDPR), including protections for children’s personal data under Article 8.
  • The California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).
  • Any additional regional or national child protection statutes applicable to territories in which the Seaya application is distributed.

Seaya maintains internal procedures to ensure ongoing compliance with these laws and reviews its child safety practices regularly to reflect changes in applicable legislation.

Child Safety Point of Contact

Seaya has designated a Child Safety Point of Contact who is responsible for overseeing compliance with these child safety standards, responding to CSAM-related inquiries, and liaising with platform partners, regulatory bodies, and law enforcement agencies as required. This representative is positioned to speak to Seaya’s enforcement and review procedures and to take action if required.

Alignment with Industry Standards

These standards are informed by and consistent with the Tech Coalition’s Child Safety Standards and Developer Good Practices for Combating Online Child Sexual Exploitation and Abuse (CSEA), the Google Play Child Safety Standards policy, and the Apple App Store Review Guidelines. Seaya is committed to continuous improvement of its child safety practices in line with evolving global standards and best practices.

Enforcement and Consequences

Any user found to be in violation of these child safety standards will be subject to one or more of the following enforcement actions, applied at the sole discretion of Seaya:

  • Immediate removal of the violating content.
  • Temporary suspension of the user’s Seaya account.
  • Permanent termination of the user’s Seaya account and prohibition from future use of the platform.
  • Reporting of the user and relevant evidence to NCMEC, law enforcement agencies, and applicable regulatory bodies.
  • Any other action required by applicable law.

Policy Updates

Seaya reserves the right to update or modify these Child Safety Standards at any time to reflect changes in applicable law, platform requirements, app features, or industry best practices. Any material changes will be reflected with an updated effective date at the top of this document. Continued use of the Seaya application following any update constitutes acceptance of the revised standards.
